APPROVAL OF THE GLOBAL LASER ENRICHMENT, LLC REQUEST FOR EXEMPTION TO BIFURCATE THE LICENSE APPLICATION FOR THE PADUCAH LASER ENRICHMENT FACILITY (ENTERPRISE PROJECT IDENTIFIER L-2024-LLL-0009)

Dear Tim Knowles:

Global Laser Enrichment, LLC (GLE), a jointly owned subsidiary of Silex Systems Limited and Cameco Corporation, submitted a letter dated June 26, 2025 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML25177D049), requesting an exemption from requirements in Title 10 of the Code of Federal Regulations (10 CFR), Section 70.22, "Contents of applications," paragraph (m) (10 CFR 70.22(m)). The exemption request seeks approval to bifurcate the submittal of the classified security plan portions of the GLE license application and to provide them no more than 8 months after submittal of the remainder of the license application, which GLE submitted on June 30, 2025. The bifurcated submittal would include the Standard Practice Procedures Plan, Program Cyber Security Plan, and Classified Matter Transportation Security Plan. Under the current requirements of 10 CFR 70.22(m), a license application must contain a full description of the applicant's security program to protect against theft, and to protect against unauthorized viewing of classified enrichment equipment, and unauthorized disclosure of classified matter in accordance with the requirements of 10 CFR parts 25 and 95. In its exemption request, GLE requests up to an 8 month delay in the submittal date (from July 1, 2025 to March 1, 2026) for it to submit the classified security plans as part of its license application.

As explained in its safety evaluation report (enclosed), the NRC staff finds that granting the exemption is authorized by law, will not endanger life or property or common defense and security, and is otherwise in the public interest. Therefore, the NRC staff grants GLE a temporary exemption from the requirements of 10 CFR 70.22(m) until March 1, 2026, approximately 8 months after receipt of the initial portion of the license application. Failure to submit a full description of the Standard Practices and Procedure Plan, Program Cyber Security Plan, and Classified Matter Transportation Security Plan in compliance with 10 CFR 70.22(m) by this date may result in the NRC extending the overall schedule of the license application review and may also result in the NRC staff denying the license application.

This letter concludes action on this submittal, and Enterprise Project Identifier L-2024-LLL-0009 is closed.
