UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, O.C. 20555-0001 July 24, 2025 This letter is in response to the petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory-Commission (NRG) on August 1, 2022 (Agencywide Documents Access and Management System Accession No. ML22284A087). You requested that the NRC revise the acceptance criteria for emergency core cooling system performance in Section 50.46, "Acceptance criteria for emergency core cooling systems for light-water nuclear power reactors,"
of Title 10 of the Code of Federal Regulations.
On November 23, 2022, the NRG published in the Federal Register a notice of docketing of your petition as PRM-50-124, which included a request for public comments (87 FR 71531). The comment period was extended by one month (88 FR 7012; February 2, 2023) and closed on March 8, 2023. The NRC received 12 comment submissions. Public comments and supporting materials related to this petition can be found at https://www.requlations.gov, by searching for Docket ID NRC-2022-0178.
The agency considered the petition and the public comments received. The NRC is denying PRM-50-124 because the agency is addressing emergency core cooling system performance with a risk-informed and performance-based regulatory approach rather than a deterministic approach as suggested in the petition. This risk-informed and performance-based regulatory approach is being considered in the "Increased Enrichment of Conventional and Accident Tolerant Fuel Designs for Light-Water Reactors" rulemaking.
