Dear Thomas McKenna,
I am writing to provide you with an update on the June 1, 2020, petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory Commission (NRC). The NRC docketed your petition pursuant to § 2.803 of Title 10 of the Code of Federal Regulations (10 CFR), "Petition for rulemaking NRC action," and assigned it Docket No. PRM 123. Please reference this docket number on any correspondence you may have concerning the petition.On August 31, 2020, the NRC published a notice of docketing and a request for comment for your petition (85 FR 53690). The comment period closed on November 16, 2020.
In your petition, you requested that the NRC revise its regulations so that protective actions implemented during a General Emergency at a nuclear power plant will most likely do more good than harm when both the possible physical health effects of radiation exposure and protective actions are taken into consideration.
The NRC is reviewing your petition and the public comments received in response to the Federal Register notice dated August 31, 2020.The Commission makes the final decision on the NRCs actions on petitions for rulemaking.After reviewing the merits of your petition and the public comments, the NRC staff prepares a recommendation to the Commission and the Commission will then make and issue its decision.
