May 5, 2025 The Honorable Shelley Moore Capito Chairman, Committee on Environment and Public Works United States Senate Washington, DC 20510

Dear Chairman Capito:

The U.S. Nuclear Regulatory Commission (NRC) is publishing the following document in the Federal Register:

Title:

Long-Term Cooling and Unattended Water Makeup of Spent Fuel Pools Description of the document: The NRC is denying a petition for rulemaking which requested the NRC amend its regulations to require that nuclear power plant licensees ensure long term cooling and unattended water makeup of Spent Fuel Pools. The NRC is denying this petition for rulemaking because the concerns were all addressed either in the August 2019, Mitigation of Beyond-Design-Basis Events rulemaking or by other industry or governmental actions. The NRC is also discontinuing its associated rulemaking activity.

For more information, see the enclosed document.

Please contact me at 301-415-1776 if you have questions or need more information.

Sincerely, Eugene Dacus, Director Office of Congressional Affairs
