Dear Secretary Burgum:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am providing the agency's status report as required by Section 5(c) of the January 20, 2025, Executive Order (EO) 14156, entitled "Declaring a National Energy Emergency." On March 13, 2025, in accordance with Section 5(a) of the EO, the NRC submitted our initial summary report listing planned or potential actions to facilitate the Nation's energy supply that may be subject to the Endangered Species Act (ESA) regulation on consultations during emergencies. Section 5(c) further directs the heads of all agencies to then submit a status report at least every 30 days for the duration of the national emergency following the submission of the initial summary report.
The NRC's status report is enclosed, reflecting the following changes since the April summary report:
The Section 7 ESA consultation for the subsequent license for the project, "Diablo Canyon Power Plant, Units 1 & 2 (Pacific Gas & Electric Co.) License Renewal Application," was completed on April 21, 2025, and has been removed from this list.
Tennessee Valley Authority submitted a Construction Permit Application for the Clinch River Nuclear Site in Oak Ridge, Tennessee on May 20, 2025, and this application has been moved from "Planned or Potential License Application Reviews," to "Current Licensing Reviews."
Per the direction in Section 5(c) of EO 14156, the NRC will continue to provide these status reports every 30 days for the duration of the declared national energy emergency.
