Dear Dir. Warden:
Enclosed is export license application, XSNM3848, which was accepted for review by the U.S.
Nuclear Regulatory Commission on March 27, 2025. In this application, Westinghouse Electric Company, LLC is seeking approval to export 700,000 kilograms (kgs) of uranium, enriched up to 5%, containing 35,000 kgs of uranium-235 in the form of uranium dioxide powder, and/or uranium dioxide pellets and/or VVER nuclear fuel rods, and/or finished VVER fuel assemblies.
The material will be used as reload fuel at South Ukraine, Rivne, and Khmelnytskyi Nuclear Power Plants located in Ukraine.
We request views from the overall perspective of the Executive Branch on this export license application, in accordance with established procedures, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended. Assurances from Ukraine that the material will be subject to all the terms and conditions of the agreement for cooperation are also required. Please note that the material has obligations from Canada, Australia, EURATOM, and the UK.
