WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE

- LONG MOTT GENERATING STATION CONSTRUCTION PERMIT APPLICATION

Dear Mr. Vaughn:

By letter dated March 31, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25090A057), Long Mott Energy, LLC (LME) submitted a construction permit application (CPA) for Long Mott Generating Station (LMGS), to be located in Calhoun County, Texas. The application contains proprietary information from LME and X Energy, LLC (X-energy). Affidavits were submitted to the U.S. Nuclear Regulatory Commission (NRC) staff and executed by Mr. Edward Stones of LME on March 26, 2025, and by Mr. Stephen Vaugh of X-energy on March 25, 2025, requesting the NRC to withhold the following information from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390, Public inspections, exemptions, requests for withholding:

a.

Part I of the CPA titled General and Financial Information b.

Technical Report titled Preliminary Plume Exposure Pathway Emergency Planning Zone Analysis, incorporated into Part VI, Supplemental Information, of the LME CPA c.

Part VII, Security-Related Information to be Withheld per 10 CFR 2.390(d)(1), which pertains to a section of Part II of the CPA titled Preliminary Safety Analysis Report, of the LME CPA Non-proprietary versions of these documents have been placed in the NRCs Public Document Room and added to the NRC Library in ADAMS.

The affidavits state that the submitted information should be considered exempt from mandatory public disclosure because public disclosure of this non-public information is likely to cause substantial harm to the competitive position of LME and X-energy, because it would enhance the ability of competitors to provide similar products and services by reducing their expenditure of resources using similar project methods, equipment testing approach, contractors, or licensing approaches.

M. Feltner The NRC has reviewed the affidavits and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavits, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection will not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC staff may send copies of the information to our consultants working in this area. The NRC staff will ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, LME and X-energy should promptly notify the NRC. LME and X-energy also should understand that the NRC staff may have cause to review this determination in the future if, for example, the scope of a Freedom of Information Act request includes this information. In all review situations, if the NRC makes a determination adverse to the above, the owner of the information will be notified in advance of any public disclosure.
