RESPONSE LETTER WITH COMMENTS ON THE INDIANA DRAFT AGREEMENT APPLICATION
Dear Ms. Eckstein:
We have completed our review of Indianas draft application to become an Agreement State in accordance with Section 274b of the Atomic Energy Act (AEA), as amended. A U.S. Nuclear Regulatory Commission (NRC) interoffice review team conducted a review to determine whether the proposed draft Indiana Agreement State Program met the evaluation criteria for an Agreement Program that is adequate to protect public health and safety and compatible with the NRC requirements. The review was performed following the guidance in the NRC Commission Policy Statement Criteria for Guidance of States and NRC in Discontinuance of NRC Regulatory Authority and Assumption Thereof by States Through Agreement that provides criteria for new agreements, and the NRC Office of Nuclear Material Safety and Safeguards Procedure SA700, Processing an Agreement, and its Handbook available in the NRCs Agencywide Documents Access and Management System Accession No. ML22138A414 and ML22140A396, respectively, to ensure a consistent and timely review in accordance with the provisions of the AEA and Commission policy.
The review team found that the request provided information on all major elements. Enclosure 1 contains the NRC staffs comments after completing the review. For your reference, the comments are correlated to the sections in your request and their pertinent sections of the SA700 Handbook. The comments are organized under general, specific, and editorial headings. For convenience, Enclosure 2 contains a markup of comments for the draft agreement. Comments to the proposed regulations were sent to Indiana on April 8, 2025, available in ML25049A263.
