PUBLICATION OF THE U.S. NUCLEAR REGULATORY COMMISSION PHASED ENFORCEMENT PLAN FOR REAL ID ACT REQUIREMENTS AT NUCLEAR POWER PLANTS This memorandum communicates the staffs plan to proceed with publishing the U.S. Nuclear Regulatory Commission (NRC) REAL ID Act of 2005 (REAL ID Act) Phased Enforcement Plan (Agency Documents Access and Management System (ADAMS) No. ML25101A213).
As permitted by the U.S. Department of Homeland Security final rule (DHS Final Rule) published on January 14, 2025 (90 FR 3472), the NRC has chosen to implement a phased enforcement plan for administering requirements of the REAL ID Act applicable to NRC regulatory requirements for licensed nuclear power plants. Discussion of the NRCs decision to implement a phased enforcement plan can be found in NRC Information Notice 2025-02 (ADAMS No. ML25043A220).
As discussed in the DHS Final Rule, agencies implementing a phased enforcement plan are required to coordinate their plans with DHS, make their plans publicly available, and achieve full enforcement by May 5, 2027. On April 2, 2025, NRC staff met with Transportation Security Administration staff to discuss the NRCs draft phased enforcement plan, and feedback from that discussion was considered in the development of the NRCs final plan. The NRC staff are now prepared to proceed with publication of the NRCs final plan on the NRC public website.
