Status of Petition for Rulemaking PRM-50-126 Date:

Tuesday, April 1, 2025 1:44:00 PM Greetings Brian Mann,

Thank you for inquiring about PRM-50-126, Technical Specifications for Nuclear Power Reactors.

By letter dated September 13, 2024, (Agencywide Documents Access and Management System Accession No. ML24274A209), you submitted on behalf of the Technical Specifications Task Force, the Pressurized Water Reactor Owners Group, and the Boiling Water Reactor Owners Group, a petition for rulemaking requesting that the NRC revise 10 CFR 50.36 to apply risk insights to the selection of technical specifications Limiting Conditions for Operation (LCO) and to update the regulation to be consistent with the guidance in the NRC's Standard Technical Specifications. The purpose of this email is to provide an update on the status of your petition.

On November 25, 2024, the NRC published in the Federal Register a notice of acceptance and docketing of PRM-50-126 and requested comments on the petition. The comment period closed on February 10, 2025, and the NRC received several comment submissions, which can be found at https://www.regulations.gov under Docket ID NRC-2024-0173. The NRC is evaluating your petition and the associated public comments. Once the NRC makes a determination on the petition, the NRC will notify you and publish a notice in the Federal Register explaining the Commissions decision.

The timeline for resolving a petition for rulemaking largely depends on the nature and complexity of the request. Generally, it takes 1-2 years for NRC to resolve a legal/technical petition; this estimate is subject to resource availability and other agency priorities.

Now that the comment period has closed, the NRC is reviewing the technical merits of the petition and the public comments we have received. This step of the petition resolution process can take approximately 6 months. The staff will draft a recommendation for review by an internal board and then prepare a formal recommendation to the Commission for approval.

This step can take roughly 8-12 months, plus additional time for the Commission to issue a decision.

Please let me know if I have addressed your request or you have any questions.

Sincerely,

Denise Edwards Rulemaking Project Manager U.S. Nuclear Regulatory Commission NMSS/REFS/RRPB (Ph) 301-415-7204
