OF MARCH 25, 2025, PUBLIC MEETING TO DISCUSS SECTIONS OF THE NATIONAL ORGANIZATION OF TEST, RESEARCH AND TRAINING REACTORS, INC. PROPOSED NEI 23-03 GUIDANCE ON THE 50.59 PROCESS FOR DIGITAL APPLICATIONS (EPID: L-2023-NFG-0002)

On March 4, 2025, (Agencywide Documents Access and Management System Accession No. ML25063A267), the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with the National Organization of Test, Research, and Training Reactors (TRTR) staff to continue to discuss endorsement of Nuclear Energy Institute (NEI) 23-03, Guidance on the 50.59 Process for Digital Applications. A list of attendees is provided as an enclosure to this memorandum.

During the meeting, NRC and TRTR representatives reviewed and implemented changes in response to NRC staff comments on NEI 23-03 guidance. Changes were made to Section 4.3.1 which included changing mentions of software failure to failure due to software to more specifically express that while a software may not fail, it may fail to perform as intended. This change was also proposed in Example 4-17, which is still under review by representatives of TRTR. Additionally, the NRC staff recommended modifying Example 4-17 and 4-18 to better reflect the discussion of activities that may result in a more than minimal increase in the likelihood of occurrence of a malfunction of an structure, system, or component (SSC) important to safety previously evaluated in the Updated Final Safety Analysis Report (UFSAR) to better consider potential SSC failures for digital modifications and considerations made when determining the effect on the likelihood of any malfunctions as the result of digital modifications.

H. Cruz Participants in the meeting also engaged in significant discussion of principle design criteria (PDC) to ensure a common understanding of the regulatory requirements and how the PDCs (as described in the FSAR) impact 10 CFR 50.59 evaluations.

Representatives scheduled the next meeting for April 15,2025, to review NRC comments on Example 4-17, Section 4.3.3, and Section 4.3.4. There were no members of the public present in the meeting
