EXTENSION REQUEST FOR THE CURRENT MEMORANDUM OF AGREEMENT BETWEEN USSOCOM AND THE NRC FOR JOINT EMBER IMMUNE TEAM SUPPORT

Dear Admiral Sands:

The U.S. Nuclear Regulatory Commission (NRC) has benefited from a long-standing partnership with the U.S. Special Operations Command (USSOCOM), through the Memorandum of Agreement (MOA) Between the United States Special Operations Command and the United States Nuclear Regulatory Commission for EMBER IMMUNE Support. The MOA includes a provision to support the NRCs force-on-force (FOF) inspection program through USSOCOMs Joint EMBER IMMUNE Team (JEIT). The JEIT members provide integral knowledge on tactics and assist the NRCs inspection team in developing exercise scenarios.

The MOA between the NRC and USSOCOM expired on March 31, 2025. The purpose of this letter is to seek your support for an extension of the MOA until a new agreement can be put in place. The delay for establishing a new MOA and providing the associated contract funding is a result of several factors including G-Invoicing (GINV) Interface implementation by the Defense Enterprise Accounting and Management System which is used by the Defense Finance Accounting Service. The NRC understands that this interface will not be ready for USSOCOM use until the fourth quarter of fiscal year 2025. Once available, a new 5-year MOA can be put in place. We anticipate that this will occur in September 2025.

As a result, an extension is requested through September 30, 2025. Of note, the period of performance for the associated funding contract, under agreement #31310019S0032 for this MOA, was extended with a modification to the contract by the NRC and accepted by USSOCOMs J3 resource advisor.

Support from the JEIT is an important element of this program and their absence could result in a reduction in the overall effectiveness of the NRCs FOF inspection program and could challenge the NRC to implement its requirements under the Atomic Energy Act of 1954, as amended.
