DEEP ATOMIC - ASSIGNMENT OF PROJECT NUMBER AND EXPLANATION OF BILLING AND FEES
Dear Mr. Theron:
By letter dated March 20, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25080A002), Deep Atomic (Switzerland) AG (Deep Atomic) expressed its intent to engage with the U.S. Nuclear Regulatory Commission (NRC) regarding commencing the preapplication process for the design certification of its MK60 small modular reactor (MK60 SMR) and requested a project number for the preapplication activities. Based on the contents of that letter, the NRC staff understands that Deep Atomic intends to engage in preapplication activities through Q4 2027.
The NRC established a project number for the preapplication licensing activities for MK60 SMR: 99902142. As such, Deep Atomic should include this project number on all correspondence associated with the preapplication licensing activities with the NRC.
The NRC staff time devoted to activities conducted specifically in support of Deep Atomics anticipated application(s) will be charged to this project number. This is pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 170, "Fees for Facilities, Materials, Import and Export Licenses, and Other Regulatory Services Under the Atomic Energy Act of 1954, as Amended."
Preapplication activities and activities associated with the review of a license application will be billed in accordance with 10 CFR Part 170. Following the issuance of a license, Deep Atomic will also be billed, as applicable, an annual fee in accordance with 10 CFR Part 171, "Annual Fees for Reactor Licenses and Fuel Cycle Licenses and Materials Licenses, Including Holders of Certificates of Compliance, Registrations, and Quality Assurance Program Approvals and Government Agencies Licensed by the NRC."
