NRC Mission and What We Do

  • The NRCs mission is to protect public health and safety, promote the common defense and security, and protect the environment.
  • For the proposed Kemmerer Unit 1 project, the NRC will

- Determine whether its safe to build and operate a proposed nuclear reactor at the Kemmerer site.

- Evaluate the environmental impacts of building and operating a nuclear reactor at the Kemmerer site.

- If licensed, inspect the construction and safe operation of the nuclear reactor.

  • The NRC also licenses reactor control room operators.

NRCs Tribal Policy Statement The NRCs Tribal Policy Statement is centered on the following principles:

1. The NRC Recognizes the Federal Trust Relationship With and Will Uphold its Trust Responsibility to Indian Tribes.
2. The NRC Recognizes and Is Committed to a Government-to Government Relationship with Indian Tribes.
3. The NRC Will Conduct Outreach to Indian Tribes.
4. The NRC Will Engage in Timely Consultation.
5. The NRC Will Coordinate with Other Federal Agencies.
6. The NRC Will Encourage Participation by State-Recognized Tribes.

Kemmerer Unit 1 Construction Permit Review -

Lead and Cooperating Agencies

  • The NRC leads the National Environmental Policy Act (NEPA) analysis and National Historic Preservation Act (NHPA) Section 106 consultation for the proposed Kemmerer Unit 1 construction permit.
  • TerraPower requested financial assistance for construction of Kemmerer Unit 1 through a cost-share partnership with DOE.

Because Federal financial assistance is considered a major federal action, DOE also has NEPA responsibilities and is a cooperating agency for the NRCs construction permit review.

NRC Project Role - Kemmerer Unit 1

  • The NRC is reviewing TerraPowers application for a construction permit

- A Construction Permit is an NRC document that authorizes an applicant to build a nuclear facility

- An Operating License application and approval is needed before the facility could start up

  • The NRC is conducting both a safety review and an environmental review of Kemmerer Unit 1

- The NRC will lead the National Environmental Policy Act (NEPA) analysis and the National Historic Preservation Act (NHPA) Section 106 consultation for the proposed construction permit.

- DOE will serve as a cooperating agency to increase the efficiency of both the NEPA and NHPA reviews.

DOE Office of Clean Energy Demonstration

  • DOE/OCED mission is to deliver clean energy technology demonstration projects at scale in partnership with the private sector to accelerate deployment, market adoption, and the equitable transition to a decarbonized energy system.
  • DOE/OCED manages DOEs Advanced Reactor Demonstration Program.
  • There are currently two advanced reactor demonstration projects in OCEDs program one of which is the TerraPower Natrium Reactor.

  • In addition to being a cooperating agency on the NRCs NEPA review for the construction permit application, the DOE is leading review for the following DOE undertakings:

Kemmerer Power Station Unit 1

  • Application for a construction permit for an advanced reactor (pool-type sodium fast reactor) submitted on March 28, 2024
  • 345 megawatts electric (MWe) with peak output of 500 MWe
  • Located in Kemmerer, Lincoln County, Wyoming 12

Proposed Kemmerer Unit 1 Site

  • Property boundary is 334-acres in Lincoln County, Wyoming
  • 3 miles south of the City of Kemmerer, and 3.8 miles southeast of the Naughton Power Plant 13

Kemmerer Unit 1 Construction Permit Environmental Review

  • The Kemmerer Unit 1 site comprises about 290 acres (within the 334-acre site boundary).
  • Our environmental and NHPA analyses include the construction of two transmission lines approximately 5.7 miles in length and a water supply pipeline approximately 6 miles in length.
  • The NRC has defined the direct and indirect area of potential effects for the cultural resources review as the site and its immediate environs, and the proposed transmission and water supply lines, which may be directly or indirectly impacted by land-disturbing and building activities associated with the construction and operation of the proposed facility.

Environmental Review Schedule

  • Environmental scoping comment period ended on August 12, 2024
  • Draft Environmental Impact Statement (EIS) - Expected issuance July 2025 day public comment period

- A copy of the Draft EIS will be made available to all Federally recognized Tribes for review and comment.

  • Final EIS - Expected issuance May 2026

- A copy of the Final EIS will be made available to all Federally recognized tribes.

  • Are there specific issues of interest or concern to the Tribes that should be considered in the environmental review?
  • What ways would the Tribes like to participate in the NEPA and NHPA review process (draft review, comments, etc.)?
  • What else do the Tribes think we need to know?
  • What protocols, points of contact, method for and frequency of communication are preferred (regular virtual meetings, in-person meetings, emails, project website)?
