With this email, the U.S. Nuclear Regulatory Commission (NRC) provides notification to U.S.

Environmental Protection Agency, Region IV of the Clean Water Act Section 401 determination related to an application for the subsequent license renewal of Renewed Facility Operating License Nos. DPR-67, and NPF-16, which authorize Florida Power & Light Company (FPL) to operate St.

Lucie Nuclear Plant (PSL) Units 1 and 2. The subsequent license renewal application dated August, 2021, filed pursuant to section 103 of the Atomic Energy Act of 1954, as amended, and part 54 of title 10 of the Code of Federal Regulations, Requirements for Renewal of Operating Licenses for Nuclear Power Plants, is publicly available at: St. Lucie SLRA. NRCs review of the subsequent

license renewal application began in September 2021 but was paused in June 2022 following Commission Orders related to the License Renewal Generic Environmental Impact Statement (LR GEIS) applicability to subsequent license renewal. Following the 2024 revision to the LR GEIS, staff is resuming its review as of March 3, 2025.

The PSL units are pressurized light-water reactors designed by Combustion Engineering and are located approximately seven miles southeast of the city of Fort Pierce, Florida. The subsequent renewed licenses would authorize FPL to operate PSL for an additional 20 years beyond the period specified in each of the current licenses. The current operating licenses for PSL expire as follows:

Unit 1 on March 1, 2036, and Unit 2 on April 6, 2043.

PSL is categorized as a Steam Electric Power Generating Point Source under 40 CFR Part 423. PSL discharges include once-through cooling water, steam generator blowdown, liquid radiation waste, intake screen wash wastewater, and stormwater associated with industrial activity. The Atlantic Ocean, a Class III marine water body, serves as the receiving waters for PSL discharges. The nature of PSL discharges is further described in Section 3.6.1.2 of the PSL Environmental Report (ER) and PSLs current National Pollutant Discharge Elimination System permit (No. FL0002208), included as Attachment B to PSLs ER. PSLs ER is included as part of the subsequent license renewal application. The Florida Power Plant Siting Act (PPSA), is the states centralized process for licensing large power plants. One license, a certification, replaces many local and state permits. Local governments and state agencies within whose jurisdiction the power plant is to be built participate in the process. As stated in Section XXVI of PSLs Conditions of Certification, the written order granting certification under the Florida PPSA also constitutes certification of compliance with state water quality standards pursuant to section 401 of the Clean Water Act. The PPSA certification is a non-expiring permit for the life of the facility and therefore remains effective and constitutes a continuing certification of compliance with state water quality standards.
