Enclosure The U.S. Nuclear Regulatory Commissions report in accordance with Section 2(b)(ii) of Executive Order 14151, of January 20, 2025, Ending Radical and Wasteful Government DEI Programs and Preferences Executive Order (EO) 14151, Sec. 2(b) states, Each agency, department, or commission head, in consultation with the Attorney General, the Director of OMB, and the Director of OPM, as appropriate, shall take the following actions within sixty days of this order:

(ii) provide the Director of the OMB with a list of all:

(A) agency or department DEI, DEIA, or environmental justice positions, committees, programs, services, activities, budgets, and expenditures in existence on November 4, 2024, and an assessment of whether these positions, committees, programs, services, activities, budgets, and expenditures have been misleadingly relabeled in an attempt to preserve their pre-November 4, 2024 function; (B) Federal contractors who have provided DEI training or DEI training materials to agency or department employees; and (C) Federal grantees who received Federal funding to provide or advance DEI, DEIA, or environmental justice programs, services, or activities since January 20, 2021.

The NRC response to requested information on positions, committees, programs, services, activities, budgets, and expenditures, in Section 2(b)(ii)(A), is below. The NRC has not relabeled any DEI, DEIA, or environmental justice positions, committees, programs, services, activities, budgets, or expenditures to preserve their function. In response to Section 2(b)(ii)(B), Federal contractors who have provided DEI training or DEI training materials to agency or department employees, the NRC had a contract with the Ivy Planning Group to provide DEI training and materials. The contract was terminated consistent with EO 14151. In response to Section 2(b)(ii)(C), the NRC did not grant Federal funding to provide or advance DEI, DEIA or environmental justice programs, services, or activities.

Positions:

Diversity, Equity, and Inclusion Outreach (DEIO) Program Manager; Special Emphasis Program Manager.

On January 23, 2025, both employees were placed on administrative leave and both positions were dissolved consistent with EO 14151. The NRC had no environmental justice positions.

Committees:

Special Emphasis Program Equal Employment Opportunity (EEO) Advisory Committees and Employee Resource Groups:

o The NRC Technical Womens Network o Blacks in Government, NRC Chapter o Veterans Employee Resource Group o Advisory Committee for African Americans

2 o Advisory Committed for Employees with Disabilities o Asian Pacific American Advisory Committee o Diversity Advisory Committee on Ageism o Federal Womens Program Advisory Committee o Hispanic Employment Program Advisory Committee o Native American Advisory Committee o NRC Pride Alliance Advisory Committee o Diversity Management Advisory Committee Diversity Management and Inclusion Council Consistent with EO 14151, the agency dissolved the Diversity Management Advisory Committee and the Diversity Management and Inclusion Council, and the agency stopped providing resources to EEO advisory committees and special emphasis groups.

Programs:

The NRC had one DEI/DEIA program in existence on November 4, 2024, the DEIO, which was established in April 2023. The program was dissolved consistent with EO 14151.

The NRC does not have an environmental justice program, though the NRC has conducted environmental justice activities as part of environmental reviews as discussed below.

Services:

Coordination and facilitation of the initiative on Civility, Awareness, Respect, and Engagement (iCARE) sessions; Coordination of the Diversity Inclusion Awareness Leading Organizational Growth Understanding and Engagement (DIALOGUE) Project sessions facilitated by Ivy Planning Group; Oversight of the EEO committees, which ensured that their special emphasis observance activities were compliant with committee charters and regulations.

All DEI/DEIA services were terminated consistent with EO 14151.

The NRC does not provide environmental justice services.

Activities:

iCARE sessions, which were established in 2020 as an intra-agency outreach program on current events and issues of diversity and inclusion; DIALOGUE sessions; EEO committee touchpoint monthly meetings.

Annual EEO special emphasis observance events.

All DEI/DEIA activities were terminated consistent with EO 14151.

The NRCs environmental justice activities as of November 4, 2024, were limited to consideration of environmental justice issues within the National Environmental Policy Act (NEPA) environmental review process. On November 4, 2024, the NRC was reviewing 23

3 applications that were subject to a NEPA review. The NRC is currently exploring options to update its NEPA practices.

Budget:

The NRCs DEI budget on November 4, 2024, was $0.3M for an expected increase in diversity and inclusion efforts and equal employment opportunity casework and 1.0 FTE to support the DEIO Program Manager position. The 1.0 FTE for the Special Emphasis Program Manager position was originally established under the Affirmative Employment Program and transferred to the DEIO program in April 2023.

These activities and positions are no longer budgeted.

The NRC has no separate budget for environmental justice activities. However, the NRCs NEPA reviews are budgeted and environmental justice issues were considered within this process as one of the review areas for environmental impact statements.

Expenditures:

Award plaques for committee members and/or retiring SES staff that were Executive Sponsors for EEO Committees; iCARE sessions planned and led by DEIO staff and employees volunteer attendance; DIALOGUE contract with the Ivy Planning Group and employees session attendance; EEO committee members monthly meetings and special emphasis observance events participation; The DEIO programs two FTEs.

The NRCs environmental justice expenditures as of November 4, 2024, were part of the NEPA environmental justice analysis and documentation within the 23 ongoing project reviews.

Typically, these reviews would account for less than two percent of each projects budget.
