PROGRAMMATIC SUSTAINABILITY OF THE FLORIDA AGREEMENT STATE PROGRAM
Dear Douglas Woodlief:
The U.S. Nuclear Regulatory Commission (NRC) values the Florida Agreement State Programs1 dedication to ensuring the safe and secure regulation of radioactive materials in the State of Florida. I want to emphasize the importance of maintaining compatibility with, and timely adoption of, the NRC regulations.
The 2019 and 2023 Integrated Materials Performance Evaluation Program (IMPEP) reviews found Florida adequate to protect public health and safety but not compatible with the NRCs regulatory program. This lack of compatibility risks creating gaps, conflicts, duplication, or other conditions that could jeopardize the orderly pattern of national efforts to regulate agreement materials. While Florida has taken steps to address overdue regulations, not all required amendments were adopted, and additional regulations became overdue during the 2023 IMPEP review period. Consequently, the Management Review Board Chair recommended that Florida strengthen senior-level engagement between the Division of Emergency Preparedness, and Community Support engagement with the Department of Healths Office of Legal Counsel to prevent further delays.
The NRC appreciates Floridas efforts to adopt regulations within the 3-year implementation deadline. However, we urge you to continue efforts to address the cross-organizational challenges that may cause unnecessary delays. We look forward to discussing Floridas progress on the adoption of all overdue regulations during the July 2025, Periodic Meeting, and learning how the agencies are collaborating to ensure timely adoption of regulations in the future. Our shared goal is to position Florida for success during the 2027 IMPEP review.
