RESPONSES TO THE ADVISORY COMMITTEE ON REVISIONS TO THE ACMUI BYLAWS Below are the U.S. Nuclear Regulatory Commissions (NRC) staff responses to the recommendations and comments from the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on revisions to the ACMUI Bylaws. In the ACMUI report, the ACMUI proposed revisions to add more detail to the conflict-ofinterest section, incorporate changes from a recent Federal Advisory Committee Act (FACA) rule, and to provide more information on conduct of the ACMUI meetings.

The ACMUI provided the following recommendations and comments to the NRC staff on November 4, 2024. The full report from the ACMUI can be found at Agencywide Documents Access and Management System Accession No. ML24326A198.

Recommendations 1.

ACMUI recommendation: The subcommittee recommended establishing a five-year periodic review of the bylaws.

NRC Response: Accepted. NRC staff has scheduled through its tracking system a review for February 2030.

ACMUI recommendation: The subcommittee provided a Track Changes version of the draft revised Bylaws with its recommended changes. Specific comments were as follows:

1) Section 1: Added requirement of Designated Federal Officer (DFO) must be present.
2) Section 2: Added prioritization of agenda items.
3) Section 3: Added remote technology information, added procedure for meetings, clarified quorum and added Chairperson expectations.
4) New Section: Titled Transcripts/Meeting Summary: Clarified expectations on timelines and certifying transcripts or meeting summary.
5) Updates for Section: Appointment of Members: added new FACA language:

membership to be fairly balanced to include those with relevant lived experience, and persons with demonstrated professional or personal qualifications. Also added Reappointment language in accordance with COMSECY96042.

6) Added new section Subcommittees: added definition of quorum, clarified Subcommittee Chairperson responsibilities, added language on subcommittee deliverables must be voted on and approved by Full Committee before sending to NRC, and add new FACA requirement of DFO must be present on all subcommittee meetings.
7) Add new section: Conflict-ofInterest: added language on expectations, added procedure to follow on conflict-ofinterest (COI) and recusal, during presentations, preparing ACMUI reports, added Chairperson and DFO responsibilities.

NRC Response: Partially accepted. The subcommittees proposed revisions, as outlined above and detailed in the Track Changes document, were accepted with the exception of the references to lived experience in Sections 5.2 and 6.1. These specific references were not incorporated into the selection process for subcommittee members because the exact phrasing is not mandated by FACAs new rule. Instead, the Bylaws outline how professional expertise and personal qualifications are carefully considered when appointing subcommittee members, ensuring a robust and balanced selection process.

The remaining additional revisions made by staff were editorial and non-substantive (e.g., ensuring consistency in capitalization, using abbreviations when warranted, and spelling out abbreviations for first use, etc.), and did not change the intent of ACMUIs proposed revisions.
