The results of the annual fatigue management program effectiveness review determined Wolf Creek is effective in controlling the work hours of individuals subject to work hour controls.

The Corrective Action Program is adequately used to identify and correct concerns with compliance to the fatigue rule requirements. All fatigue assessments did have a condition report initiated to be reviewed through the corrective action program.

FFD Summary of Management Actions Summarize actions implemented to improve FFD program performance Topic 1: Policies and Procedure CR # 10037890 - YQA Issue was identified during the performance of 24-10-FFD/FM QA Audit - Split Specimen not administered correctly.

Contrary to 10CFR26.165(f) and AP 01A-001 Fitness for Duty Program, "If the MRO confirms a positive, adulterated, or substituted test result(s) from the first Health and Human Services (HHS)- certified laboratory and the donor requests testing of Bottle B or a split specimen or retesting of an aliquot from a single specimen, WCNOC shall administratively withdraw the individual's authorization on the basis of the first confirmed positive, adulterated, or substituted test result until the results of testing Bottle B or retesting an aliquot of the single specimen are available and have been reviewed by the MRO." On 03/25/2024, the Medical Review Officer (MRO) provided documentation of a positive test but stated that the split specimen retest has been requested (Bottle B). On 03/25/2024, tŽE

KŽŽŽWCNOC denied the individual for 14 days instead of administratively withdrawing the individuals access per 10CFR26.165(f) and AP 01A-001 until the results of the split specimen was provided.

Actions taken to correct this deficiency and strengthen the FFD program -

Access Screening met with the MRO taff on 12/10/2024 to discuss the needed changes to the MRO Check list to ensure the regulation (10CFR26.165(f)) and Wolf Creek procedure (AP 01A-001) are followed when a donor requests a confirmation test from an initial positive test result. The MRO staff agreed to revise the MRO Checklist, so the MRO is aware to not to sign a confirmed positive result if a donor request a confirmatory test during the time of the interview. The MRO staff agreed to revise the form, have the Chief MRO approve the revision, and have Access Screening review prior to implementation.

On 01-09-2025, Access Screening reviewed the MRO Checklist. MRO taff added the statement If results are POSITIVE & B Bottle testing is requested notify MRO staff immediately. **STAFF: Notify WCNOC but DO NOT send report until confirmation secondary lab has been received. To ensure the correct individual information was provided, Access Screening created a Retest notification form for the MRO staff to utilize. This form has the date the re-test was requested, donor Name and ^Ž^

ESSN of the individual who requested a retest of their B specimen. This form is sent to Access Screening via secure fax. The implementing of these two forms helps mitigate WCNOC from receiving a signed report from

the MRO until the B specimen retest result is returned and confirmed, ensuring no sanctions are issued prior to that. As of 1-9-2025, both forms are approved and available for use.

With this new process, the MRO staff will notify Access Screening when an individual has requested a confirmatory test by calling Access Screening and will send the new Retest form containing the individuals information. Access Screening will place the individuals badge on a Security Clearance Hold until the 2nd test result is received. No sanction will be placed on the individual at this time. (NOTE:

The donor has 3 days in which to contact the MRO to request a confirmatory test. If the donor calls the MRO after their initial meeting to request a 2nd confirmatory test Access Screening will have already sanctioned the individual. If the 2nd test returns as negative the sanction will be removed.)

Once the 2nd confirmatory test is received and based on the test results the individuals Security Clearance hold on to their badge will be removed or they will be sanctioned per 10 CFR 26.75 requirements.

Topic 2: Policies and Procedure CR # 10037882 - This QA Issue was identified during the performance of 24-10-FFD/FM QA Audit - AI 01A-002 FITNESS FOR DUTY SCREENING section 4.23 is missing information.

AP 01A-001 FITNESS FOR DUTY PROGRAM section 4.36 defines Fitness For Duty Program Personnel (FFDPP) in the same matter as 26.4(g) but AI 01A-002 FITNESS FOR DUTY SCREENING section 4.23 is missing the section discussing 10 CFR 26.4(g)(1).

Actions taken to correct this deficiency and strengthen the FFD program -

Access Screening has revised and released AI 01A-002, FITNESS FOR DUTY PROGRAM PERSONNEL Rev.

35 to add the missing information from 10 CFR 26.4(g)(1).

Topic 3: Policies and Procedure CR # 10037888 - This QA Issue was identified during the performance of 24-10-FFD/FM QA Audit - AI 01A-002 FITNESS FOR DUTY SCREENING section 4.23 is missing information.

10CFR26.4(g) states Fitness For Duty(FFD) program personnel who are involved in the day-to-day operations of the program whose duties require them to have the following types of access or perform the following activities shall be subject to an FFD program that meets all of the requirements of this part, except subparts I and K and at the licensees discretion subpart C. 10 CFR 26.4(g)(1) indicates all persons who can link test results with the individual who was tested before an FFD policy violation determination is made. This would include Medical Review Officer (MRO) and MRO taff. 10CFR26.4(g)2 indicates all persons who make determinations of fitness. This would include the Substance Abuse

Expert (SAE). 10 CFR 26.29 states FFD training and refresher training should be completed for all individuals who are subject to this part. Access Screening/FFD stated that the MROs, MRO taff and SAEs received initial training but do not complete FFD program training or refresher training annually. This is not in compliance with FFD program personnel being subject to 10 CFR 26.29 and 10 CFR 26.4.

Actions taken to correct this deficiency and strengthen the FFD program -

FFD Program Owner is currently working with the NEI Senior Technical Advisor and industry peers on alignment to 10 CFR 26.29 and 10 CFR 26.4 and NEI 03-01 to ensure Wolf Creeks MROs and MRO staff are taking all the required training to meet the regulation requirements.

Topic 4: Other Access Screening implemented new alcohol testing equipment. The previous equipment was over 12 years old and started having problems. The machines were expensive to repair, and it became increasingly more difficult to find replacement parts. The new equipment purchased is more reliable and more efficient. Two members of the Access Screening team became qualified trainers on the new equipment. All current FFD Collectors were trained successfully on the new equipment.

The Collector heard the sound of a paraphernalia container lid hit the floor while the donor was in the bathroom giving the specimen. The specimen's temperature was out of range. When the supervisor was brought into the room the donor admitted to bringing in a device that carries urine into the testing facility to give a urine specimen that was not theirs. The donor then handed over the device.

Donor's specimen had no bubbles but could be heard urinating with force. Specimen was about 1/2 cup and had low temperature (still in range) Specimen had no odor. It appeared to look like an oily yellow substance.

Collector asked for a direct observation test, the donor refused and said he messed up and took out the bottle of synthetic urine from is waste band.
