REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE OF REPLOY POWER CORPORATE OVERVIEW PRESENTATION AND REGULATORY ENGAGEMENT PLAN
Dear Mr. Statile:
By letter dated July 31, 2024, REPLOY Power Inc. (REPLOY), submitted a letter of intent to engage in pre-application activities in regard to its Submerged Power Station nuclear power plant concept, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24228A241), and in a letter dated September 25, 2024, REPLOY submitted its initial regulatory engagement plan (REP) (ML24270A054) to the U.S. Nuclear Regulatory Commission (NRC) staff in support of a future licensing application.
In Enclosure 3, of the July 31, letter (ML24228A241), and Enclosure 1 of the September 25, 2024, letter (ML24270A053), REPLOY included an affidavit requesting that the proprietary information contained in a REPLOY Corporate Overview Presentation used as part of a July 24, 2024, drop-In meeting with NRC Management staff (ML24228A247), and the REPLOY REP Revision 0 (ML24270A054), be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 2, 2.390. The staff evaluated the request for withholding on the REPLOY presentation and the REPLOY REP Revision 0 and verified that the withholding determinations were valid. Therefore, the REPLOY presentation and the REP Revision 0, marked as proprietary, will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
