NUCLEAR REGULATORY COMMISSION STAFF AND THE DEPARMENT OF ENERGY On February 14, 2025, the U.S. Nuclear Regulatory Commission (NRC) staff emailed a representative of the Department of Energy (DOE). The email focused on issuance of the environmental assessment (EA) for the NRCs review of the Long-Term Surveillance Plance (LTSP) for the Durita Mail Tailings Site in Montrose County, Colorado, and in particular, the issuance schedule pertaining to Section 107(g)(1)(B) of the National Environmental Policy Act of 1969, as amended (NEPA). The NRC staff provided background information regarding the changes to NEPA that necessitated the discussion, highlighted the uncertainty in the schedule due to Bureau of Land Management (BLM) review of the Public Land Order, and stated that the EA and finding of no significant impact would be published no later than 8 weeks after the DOE submits the final LTSP to the NRC for review. The schedule is based on the submittal of the updated LTSP rather a specific date to allow for uncertainty in the BLM and DOE review schedules. This memorandum constitutes the NRC staffs consultation with DOE regarding the EA deadline consistent with Section 107(g)(2) of NEPA.
