PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). This is a standard notification given to all requesters; it should not be taken to mean that any excluded records do, or do not, exist.

We have withheld certain information pursuant to the FOIA exemptions described, and for the reasons stated, in Part II.

David Levinthal 02/04/2025 As modified, any emails from 11/4/2024-11/9/2024 that include 19 specified words/terms (plus 4 additional pejorative terms if any of the other 19 words/terms appeared), which would reflect upon government officials reactions to the result of the 2024 election.

Your request, as originally submitted, sought "any records and documents - including but not limited to emails, memoranda, notes, electronic chat messages and calendar items - that include any of the following words/terms in either uppercase or lower case form: Donald, Trump, Kamala, Musk, Elon, DJT, D.J.T, MAGA, fascist, fascism, authoritarian, authoritarianism, autocrat, dictator, commie, deep state, swamp, Project 2025, J6, bitch, fuck, fucked, shit" for the date range, November 4-9, 2024.

Upon receipt of your request on November 26, 2024, we reached out to you to discuss your request. We informed you that the NRC would not maintain electronic chat messages dating back to November 4-9, 2024. With respect to any emails that may be responsive, you agreed that emails containing any of the four pejorative words would only be responsive if the emails also contained one of the first 19 words/terms enumerated in your request, given that your request is in furtherance of reporting you are working on about government officials' reactions to the result of the 2024 election. You also agreed that emails that circulate newsletters or other publications that contain one or more of the words/terms you identified, without commentary offered about that newsletter/publication, would not be responsive to your request.

Based upon the above, the NRC did not identify any records responsive to your request.
