Subject:
NEI Request and Input for Current 10 CFR 50.55a Rule Making
Reference:
NEI letter from Mr. T. Basso to C. Araguas, NRC dated January 22, 2025
Dear Mr. Basso:
This letter is to acknowledge receipt of the Nuclear Energy Institute (NEI) letter dated January 22, 2025 that proposes changes for consideration in the current 10 CFR 50.55a rulemaking and recommendations for inclusion of code cases in the next draft revisions to Regulatory Guide (RG) 1.84, Design, Fabrication, and Materials Code Case Acceptability, ASME Section III, and RG 1.147, Inservice Inspection Code Case Acceptability, ASME Section XI, Division 1.
We appreciate the explanation of NEIs proposed changes to 10 CFR 50.55a in Attachment 1 of your letter along with your basis for your recommendation that the agency reconsider inclusion of the listed Section III code cases in the next revision of RG 1.84 in Attachment 2 of your letter.
The NRC staff will evaluate your request to determine if it meets the NRCs requirements in § 2.802 of Title 10 of the Code of Federal Regulations, Petition for rulemaking - requirements for filing, for docketing of a petition for rulemaking.
In addition, we acknowledge your support of the letter submitted by ASME Board on Nuclear Codes and Standards on behalf of the ASME Boiler and Pressure Vessel Committee on Nuclear Inservice Inspection (BPV XI) for the NRC to consider including Section XI, Division 1 Code Cases N-752-2, N-788-2, N-926, N-935, and N-939 in draft revision 22 to Regulatory Guide 1.147. They will be considered in the 10 CFR 50.55a rulemaking and revisions to RG 1.147.
Thank you for the NEI recommendations. The NRC appreciates the open dialogue with NEI and ASME and welcomes future correspondence as the NRC continues to support the development, revision, and use of Regulatory Guides and ASME Codes and Standards. If you have questions or concerns, please contact me at Christian.Araguas@nrc.gov or 301-415-7210.
Sincerely, Christian Araguas, Standards Executive Director, Division of Engineering Office of Nuclear Regulatory Research February 7, 2025 Signed by Araguas, Christian on 02/07/25
