Licensees Filing for Bankruptcy Protection

SUBJECT:

Proceedings, NRC Form 1121 "Bankruptcy Information Request Form, Post Filing" NRC Request for Information Relating to Program Activities During Bankruptcy on, through which you provided notice that:

The NRC requires this immediate notification of bankruptcy protection so that the NRC may, if necessary, take prompt action to ensure that NRC-regulated materials in the licensee's possession remain under adequate control and are only transferred or disposed in accordance with applicable regulations.

We are in receipt of the notification submitted to the U.S. Nuclear Regulatory Commission (NRC) has filed for bankruptcy protection within the court of:

The filing of a bankruptcy petition does not relieve a licensee from its obligation to comply with NRC requirements or the terms of its license. The license remains and will continue to remain in effect, pursuant to sections 81, 161, and 183 of the Atomic Energy Act of 1954, as amended (42 U.S.C.

Sections 2111, 2201, and 2233) and NRC's regulations at Title 10 of the Code of Federal Regulations (10 CFR) Part 30.34, Terms and conditions of licenses, with respect to the possession, transfer, and storage of licensed radioactive material remaining in the licensee's possession, as contamination or in other forms, until NRC notifies the licensee, in writing, that the license is terminated. The NRC may continue to conduct inspections or engage in other regulatory activities during the pendency of a bankruptcy proceeding, including the issuance of orders, to ensure public health and safety.

To ensure radioactive materials remain controlled and essential parts of the radioactive material licensee's radiation protection program continue to function, the NRC requests a prompt response to Form 1121 questions, listed below.

NRC will use this information to evaluate a licensee's ability to maintain a compliant radiation protection program during the time duration of their bankruptcy proceedings. Responses must be sent to the appropriate NRC Regional Administrator via the address or email address identified in 10 C.F.R. § 30.6(b)(2). To better ensure your response is timely received please CC the contact below when submitting NRC Form 1121 responses.

Please provide responses to the following questions relating to your licensed activities during bankruptcy proceedings:

(1) Specify all other radioactive material licenses by license number and location of facility that may be affiliated with the company's bankruptcy filing.

(2) List all radionuclides in sealed or unsealed form, or devices that contain radionuclides, that are currently possessed by licensees listed in question 1. Include as applicable any generally licensed material.

(3) Indicate if you plan to dispose or transfer any of the radionuclides or devices listed above during bankruptcy proceedings.

(4) For each of the radionuclides or devices identified above, specify whether their location of storage and method of control has changed since the bankruptcy filing.

(5) For each of the radionuclides or devices identified above, specify whether they are currently in use.

(6) Indicate whether any changes have taken place in terms of the radiation safety officer(s) or authorized user(s) listed on the on the radioactive material license(s) for the licenses listed in question 1.

(7) Specify the type of bankruptcy protection that was filed in court, such as Chapter 7, 11, or 13, for each radioactive material licenses listed in question 1.

(8) Describe any changes that are planned for the licensee's operation regarding the possession, use, storage, transfer, or disposition of any radionuclides or devices listed in any response above, during the bankruptcy proceedings.

(9) Indicate the anticipated date when the bankruptcy will end.

(10) Specify a contact person who will immediately update NRC about any changes in the status of the radionuclides, sealed sources, or devices, or of the bankruptcy proceedings. Status of radionuclides to include any change in the use, security, and/or storage of the radionuclides, sealed sources, or devices, as well as any change in the individuals responsible for the radionuclides, sealed sources, or devices.

Verify information about devices by reviewing the label on the outside of the device. For safety reasons, DO NOT TRY TO TAKE APART any device to verify this information. If you are uncertain how to identify the device's label, contact the device's manufacturer or an authorized service agent for this information. Also, contact the manufacturer for any additional information about NRC requirements.

Review all questions of the information collection form before preparing responses. Provide a detailed response to each question and submit each response as a separate enclosure to form submission.
