SUBJECT:
DESIGNATION OF GLOBAL LASER ENRICHMENT, LLC, AS THE NON-FEDERAL REPRESENTATIVE FOR THE PROPOSED GLOBAL LASER ENRICHMENT PADUCAH LASER ENRICHMENT FACILITY (DOCKET NUMBER:
70-7033)
Dear Lee Andrews:
With this letter, the U.S. Nuclear Regulatory Commission (NRC) gives written notice to the U.S. Fish and Wildlife Service (FWS) of the designation of Global Laser Enrichment, LLC (GLE) as its non-Federal representative to conduct informal consultation under Section 7 of the Endangered Species Act of 1973, as amended (ESA) for the Paducah Laser Enrichment Facility (PLEF) pursuant to Title 50 of the Code of Federal Regulations (50 CFR) 402.08, Designation of non-Federal representative.
In December 2024, GLE submitted an environmental report for the PLEF, which provides information specified in Title 10 of the Code of Federal Regulations 51.45 to support the NRCs evaluation of the environmental impacts of licensing the PLEF to meet requirements of the National Environmental Policy Act of 1969, as amended (Agencywide Documents Access and Management System No. ML24365A109). As part of its review, the NRC staff must consult with the FWS if the proposed action may affect federally listed species or critical habitats in accordance with ESA Section 7(a)(2). By designating GLE as the designated non-Federal representative, GLE will conduct consultation with your office in accordance with the regulations that guide informal consultation at 50 CFR 402.13. The NRC understands that the ultimate responsibility for compliance with ESA Section 7 remains with the NRC, as the Federal action agency.
