Dear Mr. Warden:
I refer to my letter dated January 21, 2022, requesting the views of the Executive Branch for an application (XCOM1343), received by the U.S. Nuclear Regulatory Commission (NRC) from Curtiss-Wright Flow Control Corp (Curtiss-Wright). The application requests the export of reactor components and equipment, replacement, and spare parts, including, but not limited to, nozzle check valves as described in paragraphs (5) through (11) of Appendix A to Title 10 Code of Federal Regulations (CFR) Part 110 to China for installation at the Sanmen Nuclear Power Plant, Units 1 and 2.
Enclosed is a revised application (XCOM1343) from Curtiss-Wright, dated January 25, 2024.
The revised application updates the company point of contact and adds Ningbo Xiayu Import &
Export Co., Ltd. as an intermediate consignee.
Before taking action on this request, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended.
Please note that the dollar amount on page one of the NRC Form 7 is proprietary information.
The NRC will not include this information in the public record and requests that the Executive Branch agencies protect it as well.
