GE HITACHI NUCLEAR ENERGY AMERICAS, LLC - NOTICE OF VIOLATION; NRC SECURITY INSPECTION REPORT 07000754/2024401
Dear Kristopher Zanotto:
This letter refers to the announced inspection that was performed from March 18-22, 2024, at your facility in Sunol, California. The inspection examined activities conducted under your license as they relate to public health and safety and to confirm compliance with the U.S. Nuclear Regulatory Commission (NRC) rules and regulations and with the conditions of your license. The inspection consisted of an examination of selected procedures and representative records, observation of licensed activities and facilities, walk-downs of relevant areas, and interviews with personnel. A final exit briefing was conducted via videoconference with you and members of your staff on September 17, 2024. Details of the inspection and associated apparent violations were provided to you in the subject inspection report, dated September 19, 2024 (nonpublicly available Agencywide Documents Access and Management System (ADAMS) Accession No. ML24248A132 and publicly available ML24250A203).
On November 14, 2024, a predecisional enforcement conference was conducted at the Region IV office with you and members of your staff to discuss the apparent violations, their significance, their root causes, and your corrective actions.
Based on the information developed during the inspection and the information provided during the conference, the NRC has determined that violations of NRC requirements occurred. These violations are cited in non-public Enclosure 1, Notice of Violation (Notice) and the circumstances surrounding them are described in detail in the subject inspection report.
The enclosures contain Sensitive Unclassified Non-Safeguards Information.
When separated from the enclosures, this cover letter is decontrolled.

OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION The violations involved failures associated with security requirements. Some of these violations have been categorized in accordance with the NRC Enforcement Policy as escalated enforcement. The NRC Enforcement Policy is available on the NRCs website at http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. Enclosure 2 (non-public) documents the NRC enforcement basis. In accordance with the NRC Enforcement Policy, a civil penalty is considered for any escalated enforcement violation.
Because your facility has not been the subject of an escalated enforcement action within the last two routine inspections, the NRC considered whether credit was warranted for Corrective Action in accordance with the civil penalty assessment process in Section 2.3.4 of the NRC Enforcement Policy. The NRC has determined that Corrective Action credit is warranted based on the prompt and comprehensive corrective actions you implemented. Your corrective actions to address the violations were documented in the subject inspection report and were provided at the predecisional enforcement conference on November 14, 2024.
Therefore, in recognition of the absence of previous escalated enforcement action, and your prompt and comprehensive corrective actions, I have been authorized, after consultation with the Director, Office of Enforcement, not to propose a civil penalty in this case. However, significant violations in the future could result in a civil penalty. In addition, issuance of this escalated enforcement action may subject you to increased inspection effort.
You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.
In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room and from the NRCs ADAMS, accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. The NRC also includes significant enforcement actions on its website at http://www.nrc.gov/reading-rm/doc-collections/enforcement/actions.
However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosures will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs ADAMS.
