Reply to Notice of Violation Dated 22 April 2024 License Number R-83; Docket 050-00128 In accordance with the provisions of 10 CFR 2.201, the Nuclear Engineering & Science Center (NESC), a part of the Texas A&M Engineering Experiment Station, is submitting herein a statement of explanation in reply to the Notice of Violation (NOV) resulting from the inspection conducted at the Nuclear Science Center Reactor (NSCR) from 11-14 December 2023, and 9-11 January 2024. The Facility acknowledges that the report was not submitted within thirty days of the notice as required.
This resulted from a failure in record maintenance and follow-through by staff.
The Notice of Violation, dated 22 April 2024, describes one Severity Level IV (SL-IV) violation, and two SL-IV violations being treated as non-cited violations (NCVs). The NESC does not contest any of these violations.
With respect to the cited SL-IV violation described in the NOV of 22 April 2024, which describes a case of the NRC not being notified within thirty days of identification of medical conditions arising with two NESC licensed operators, the NESC offers the explanation that due to changes in the Level-3 staff, and changes in the personnel that maintain the Operator Requalification Program, the conditions were missed and thus not reported. Additionally, the condition of the one operator should have been reported to the NRC upon application for an operating license examination, but the NESC was not informed of it at the time.
There has been a complete change in staffing in the responsible positions for Operator Qualification and Requalification since the incidents. Modifications are being made to the trainingand record keepingto prevent this from occurring in the future. The medical facility where the physical exams are conducted has also been changed as of September 2024. The NESC expects to have a complete overhaul of the qualification and requalification plan documentation complete by June 2025.
