Dear Lesley Pacey:
On behalf of the U.S Nuclear Regulatory Commission (NRC), I am responding to your email, FW: The NRC is doing a wholesale purge of important records from ADAMS, sent on November 22, 2024. In the email, you express concern, on behalf of the Government Accountability Project (GAP), that documents classed as draft in the NRCs Agencywide Documents Access and Management System (ADAMS) might pertain to active FOIA requests (e.g. FOIA Nos.: NRC FOIA-2024-000552 and NRC FOIA-2024-000553) and, as such, that GAP expects that the NRC abide by the Freedom of Information Act (FOIA) case law and not destroy any records that might fall within the scope of any of GAPs FOIA requests until all legal appeals are exhausted. The NRC considers responding to FOIA requests a vital responsibility.
We appreciate your concern and write to assure you that the NRC has not implemented any policy designed to destroy and will take appropriate action to protect any records potentially subject to pending FOIA requests or other demands for information, including those requests tendered by GAP referenced in your email.
As captured in the thread attached to your email, the NRCs Office of the Chief Information Officer (OCIO) sent an email, Keeping Documents under Draft Document Class in ADAMS, to all NRC staff on November 21, 2024. In that email, OCIO stated, After one year from date added into ADAMS, draft documents must be finalized and declared as an Official Agency Record. If they are not finalized and declared, they will be proposed for removal from ADAMS.
This email bulletin served to remind the NRC staff of their recordkeeping obligations while at the same time avoiding the accumulation of redundant and/or duplicative documents within ADAMS, the agencys official recordkeeping system.
