Dear Mr. Barwell,

On October 24, 2024, the Nuclear Energy Institute (NEI)1, on behalf of its members submitted a fee exemption request for NEI 11-02, Change Management Plan-Evaluated Force-on-Force Exercises, Revision 1. Subsequent to that submittal, a public meeting was held on November 13, 2024, related to realism within the Force-On-Force (FOF) program, where discussions identified the need for additional engagements and a review of the process for resolving disputes during FOF scenario development prior to submittal of NEI 11-02. The engagements and process reviews were not considered when we submitted our October letter, and therefore may not be included in a fee exemption granted under that letter.

NEI requests that the NRC supplement the October 24, 2024, fee exemption request for NEI 11-02 to include any pre-submittal meetings and reviews of conceptual or developmental documents that support the submittal of NEI 11-02, Revision 1, for endorsement. The related meetings and conceptual or developmental documents will help to ensure efficiency in the development and NRC review of NEI 11-02 and therefore meets the exemption requirement in 10 CFR 170.11(a)(1)(ii). Specifically, these meetings and reviews will assist the NRC in generic regulatory improvements or efforts (e.g., rules, regulatory guides, regulations, policy statements, generic letters, or bulletins).
