SUBJECT:

LITTLE TRAVERSE BAY BANDS OF ODAWA INDIANS PARTICIPATION IN THE ADVANCE NOTIFICATION PROGRAM

Dear Chairperson,

Gasco:

Thank you for your decision to participate in the U.S. Nuclear Regulatory Commission (NRC)

Advance Notification program for Federally recognized American Indian and Alaska Native Tribes, as stated in your October 15, 2024, letter. Your letter can be found in the NRCs Agencywide Documents Access and Management System (ADAMS) under Accession No. ML24297A488.

The Advance Notification to Native American Tribes of Transportation of Certain Types of Nuclear Waste (Advance Notification Rule) published on June 11, 2012 (77 FR 34194),

amended NRC regulations in Title 10 of the Code of Federal Regulations (10 CFR) Parts 71 and 73 to require licensees to provide advance notification to participating Federally recognized Tribal governments regarding shipments of certain commercial irradiated reactor fuel and nuclear waste which may be transported on NRC-approved routes within or across Tribal reservations. Participation in the Advance Notification Program requires that Tribal officials and or their designees have a need-to-know, necessary protection measures in place that will be implemented for safeguards, as described in NUREG/BR-0362, Protection of Safeguards Information: Requirements for Tribes Participating in the Advance Notification of Irradiated Reactor Fuel Shipments, and completion of the NRC self-directed course, Safeguards Information (SGI) Awareness Training. Also, Tribal officials are provided a map to verify reservation boundaries.

The NRC acknowledges the two designees that you identified below as having met the requirements of the program and are able to receive advance notifications of certain commercial irradiated reactor fuel and nuclear waste shipments that are transported by NRC and Agreement State licensees under the requirements in 10 CFR Parts 71 and 73.
