Dear Mr. Warden:
Enclosed is an application accepted by the U.S. Nuclear Regulatory Commission (NRC), on November 7, 2024, from Troxler Electronic Laboratories, Inc., requesting to amend active license XB1367. This license is currently authorized to export three portable moisture density gauges, each containing a Cs-137 source with an activity level of 0.000333 terabecquerel (TBq), not to exceed 0.000999 TBq of Cs-137 for all three gauges. Each gauge also contains an Am-241/Be source with an activity level of 0.001628 TBq, not to exceed 0.004884 TBq of Am-241/Be for all three gauges to Iraq.
The purpose of the amendment is to 1) extend the expiration date from June 10, 2025, to June 10, 2027; 2) add a U.S. Party to the Export; 3) add two Intermediates Consignees and one Ultimate Consignee; and 4) add 1 device with 2 sealed sources installed in portable nuclear moisture density gauge for quality control testing of construction materials in the field.
Since Iraq is on the embargoed list (10 CFR Part 110.28), before taking action on this request, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended.
