Dear Agency Chief FOIA Officers and Principal FOIA Contacts,
We are reaching out because it has come to OIP's attention that several agencies have received FOIA requests for "Documents sufficient to identify and account for all materials submitted by the Agency through the 0MB MAX Portal (https://collect.max.gov) during the previous fiscal year, including, but not limited to, responses to Requests for Information (RFls),
documentation related to strategic plan implementation responses, periodic assessments (e.g.,
30-day, 60-day, 90-day, 120-day assessments), underlying data, policy responses, and any other associated records."
As you know, 0MB Max.gov is a government-wide platform for advanced collaboration and information sharing to facilitate cross-government collaboration and knowledge management, including with the White House. Given the nature of 0MB Max, as agencies respond to these requests, we wanted to remind you of the need to engage in consultations with 0MB, as well as with any other agency or the White House that has equity in those records. For reference, OIP has provided guidance about FOIA consultation procedures at https://www.justice.gov/oip/blog/referrals-consultations-and-coordination-procedures-processing-records-when-another-agency. We also address the need for consultations with the White House on records involving White House equities at https://www.justice.gov/oip/oip-guidance/Processing Reminders As Agencies Enter Last Quarter of Fiscal Year 2017.
