I am responding to your correspondence to the U.S. Nuclear Regulatory Commission (NRC) dated September 16 and October 2, 2024, related to the options for licensing of emerging technologies to remediate mine waste.

Thank you for your interest in this topic. The NRC staff appreciates hearing your perspective, and your interest in public participating going forward. Remediation of abandoned uranium mine sites in and around Native American communities is a significant issue. The Commission has directed the NRC staff to implement Option 2b. Under this option, the NRC staff will license mine waste remediation technologies under the source material framework via a service provider license. In its staff requirements memorandum, the Commission has directed the NRC staff to engage with the public to define the term ore using notice and comment opportunities. Additionally, the Commission has directed the NRC staff to conduct outreach with Agreement States and Tribes to identify concerns and regulatory gaps, and assure regulatory jurisdiction is as consistent and clear as possible.

We are developing our approach to implement the Commissions direction and will notify you when the opportunity for comment is available.
