OF THE SEPTEMBER 30, 2024, COMMENT-GATHERING PUBLIC MEETING ON THE ADVANCE ACT OF 2024, SECTION 401 - ADVANCED METHODS OF MANUFACTURING AND CONSTRUCTION The U.S. Nuclear Regulatory Commission (NRC) staff from the Office of Nuclear Reactor Regulation (NRR), the Office of Nuclear Material Safety and Safeguards (NMSS), and the Office of Nuclear Regulatory Research (RES) held a meeting on September 30, 2024 to solicit external stakeholder input to support the development of the NRC report that will be submitted to Congress related to advanced methods of manufacturing and construction for nuclear energy projects, as described in Section 401 of the ADVANCE Act.

The meeting notice and agenda, dated September 30, 2024, are located at Agencywide Documents Access and Management Systems (ADAMS) Accession No ML24271A182. The slides for the staff presentation are also available (ML24269A140). A list of participants is provided as Enclosure 1.

The NRC staff began with an overview of Section 401 of the ADVANCE Act and discussed each of the subsections within Section 401. The NRC staff discussed the purpose of the public meeting and emphasized the importance of receiving feedback and input from external stakeholders to support the staffs development of the report. The NRC staff noted that the report is due to the appropriate committees of Congress by January 5, 2025.

Following the NRC presentation, the meeting moved to the comment-gathering portion of the agenda. This portion was organized by the subsections of Section 401 to ensure that time was allotted for each subsection.

For Section 401(c)(1)(A), a representative from the Breakthrough Institute provided their understanding and insights on rapid improvement and iterative innovation process, and how current and potential future regulatory processes can impact both topics. A representative from the Nuclear Energy Institute (NEI) noted that many codes and standards are being developed or revised to apply new materials or new design principles, and in order to apply them efficiently, opportunities for risk information and performance-based approaches should be identified and collaborated upon among all stakeholders. A representative from ClearPath noted that advanced manufacturing technologies and processes are being developed through different codes sections and code cases. A representative from the Argonne National Laboratory noted that codes and standards are very important for adopting any new materials and advanced manufacturing techniques and that some new technologies are not necessarily able to be quickly incorporated into the American Society of Mechanical Engineers (ASME) Code. The representative provided their perspective on how new tools and technical data can be used to establish technical bases to qualify the material manufacturing technology and verify the performance of material.

For Section 401(c)(1)(B), a representative from NEI discussed the requirements related to the transport of a fueled reactor core from a manufacturing licensee and the consideration of the status of the fuel within the current regulatory framework.

For Section 401(c)(1)(C), a representative from NEI discussed the definition of safety aspects in relation to the safety aspects of advanced manufacturing processes.

For Section 401(c)(1)(D), a representative from ClearPath noted that any actions that will be implemented should not only consider the existing regulatory framework or new rulemaking, but also different processes and procedures that could be used to implement the current rules and guidance.

For Section 401(c)(1)(E), a representative from NEI noted concerns about the existing supply chain and discussed alternative quality management programs.

For Section 401(c)(1)(F), a representative from NEI noted the NRC Commission messages relating to new and advanced reactors.
