I am reaching out to you regarding the state comment period for the NRC draft EA for the 40-year license renewal of the Diablo Canyon ISFSI provided below on September 5.

The deadline for state comments on the draft EA was COB yesterday, Monday Oct 7. However, the NRC staff can respond to and incorporate any comments the state may wish to provide by COB Friday Oct 11. Any comments received after that date will be considered where possible, but the NRC does not guarantee any comments received after Oct 11 will be fully considered prior to the publication of the EA and FONSI for this licensing action.

Please let me know if you have any questions or comments you would like to provide to the NRC on the draft EA for Diablo Canyon ISFSI License Renewal. You may also respond that the state has no comments and concurs with the NRCs findings. The NRC will presume the state to concur in the case of no response.

As noted in the watermark, this is a draft EA and is therefore a pre-decisional document. The draft EA should not be disclosed outside of CDPH without prior written NRC permission.

Dear Mr. Fassell,

Please find attached a draft Environmental Assessment (EA) prepared by the staff of the U.S. Nuclear Regulatory Commission (NRC). The draft EA provides the NRC staffs evaluation of the potential environmental impacts of Pacific Gas and Electrics (PG&E) request for the license renewal for the Diablo Canyon Independent Spent Fuel Storage Installation (ISFSI) in San Luis Obispo County, California.

PG&E is proposing a 40-year license renewal to continue to operate the ISFSI at Diablo Canyon until March 22, 2064. The proposed action does not include any increases to the total storage capacity or size of the ISFSI and thus includes no major construction or refurbishment of the site.

By this email, the NRC staff respectfully requests the review of the draft EA by your staff and by staff in other divisions of the CDPH, as appropriate, and the NRC staff appreciates any comments that result from this review. As noted in the watermark, this is a draft EA and is therefore a pre-decisional document. The draft EA should not be disclosed outside of CDPH without prior written NRC permission.
