REQUEST FOR DOCUMENTS
Dear Keith Everly:
On September 25, 2024, you submitted a request on behalf of Laser Isotope Separation Technologies (LIST) and NANO Nuclear for documents produced by the U.S. Nuclear Regulatory Commission (NRC) and the Nuclear Energy Institute (NEI) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24276A180). The documents you requested contain Sensitive Unclassified Non-Safeguards Information. The NRC staff provides these types of documents to applicants on a case-by-case basis, provided there is sufficient docketed need-to-know, typically in the form of a letter of intent to apply for an NRC license, establishment of an NRC docket, pre-application meetings, etc. Given the sensitive nature of these documents, the NRC requires additional information on the application status of these companies before it can authorize the release of the requested materials. You may request that the NRC staff reconsider its decision once LIST and NANO Technologies have established sufficient docketed need-to-know. Finally, the NRC is unable to provide a copy of NEI 08-11, Information Security Program Guidelines for Protection of Classified Matter at Uranium Enrichment Facilities, as this documents distribution is controlled by NEI.
In the interim, the following regulations related to may provide helpful information on the NRCs regulatory requirements for fuel cycle facility information security:
