Upon receipt of your request, we tasked staff in the U.S. Nuclear Regulatory Commission (NRC)'s Region IV office to search for, and provide disclosure recommendations about, any responsive records. Because some of the records originated with, or contained information originating with, the licensee of the Comanche Peak Nuclear Power Plant we initiated several consultations with Luminant, which is the plant's licensee, to ascertain whether the records contained information it considered proprietary or critical energy/electric infrastructure information (CEII). Once having received Luminant's views, we solicited RIV staff's views about those claims. Finally, with respect to the records that were believed to consist or contain CEII, we initiated a consultation with the Federal Energy Regulatory Commission (FERC), which has been given the statutory authority to make CEII designations. Now that the consultation with FERC is complete, we are issuing our final response to you.
Some of the responsive records have been determined to be releasable to you, in whole or in part. (please refer to Part II for the exemptions claimed). They are enclosed. In addition, two reports, the "ABB Report" and "Doble Report", consisting of 19 and 16 pages, respectively, as well as 28 pages of photographs taken at the plant, have been withheld in their entirety on the basis of FOIA exemption 3, in conjunction with 16 U.S.C. 824o-1 (CEII), and FOIA exemption 4. Finally, in addition to the enclosed records, please note that there are two responsive records that are already available to the public in NRC's official record repository, Agencywide Documents Access and Management System (ADAMS) and may be located under the following accession numbers: ML21174A094 and ML21216A3866.
