2.206 PETITION REGARDING SEISMIC CORE DAMAGE FREQUENCY FOR DIABLO CANYON NUCLEAR POWER PLANT, UNITS 1 AND 2

Hallie Templeton, and Caroline Leary:

I am responding to your letter dated September 11, 2024 (Agencywide Documents Access and Management System Accession No. ML24262A246). The U.S. Nuclear Regulatory Commissions (NRCs) Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions (ML18296A043), and the associated Desktop Guide (ML21237A347), was referenced in the acknowledgement letter dated August 27, 2024 (ML24205A066).

Management Directive 8.11 and the Desktop Guide are publicly available and apply to all 10 CFR 2.206 petition evaluations undertaken by the NRC staff.

Please be assured that the Petition Review Board will be following the process outlined in MD 8.11. This will include making effort to utilize staff with relevant expertise that were not involved in previous decisions and considering peer review of the Petition Review Boards work.

Also, in the event that the NRC determines enforcement action is warranted, the licensee may have the right to a hearing. Any such hearing would be held in accordance with the rules in 10 CFR Part 2.
