Dear Benjamin Williams:

As provided for under Section 2.C. of the Memorandum of Understanding (MOU) between the U.S. Nuclear Regulatory Commission (NRC) and the Federal Energy Regulatory Commission (FERC) regarding Critical Energy/Electric Infrastructure Information (CEII),1 this letter is to consult with you, as FERCs CEII Coordinator, for a supporting determination of the designation of the material identified in the enclosed document(s) as being CEII that is exempt from public disclosure under Exemption 3 of the Freedom of Information Act, 5 U.S.C. § 552(b)(3), pursuant to Section 215A of Part II of the Federal Power Act, 16 U.S.C. § 824o-1.

Pursuant to Section 2.C., the NRC staff has provided the following information to assist you in making a CEII determination:

1.

The information proposed for redaction in the four enclosed records, reflecting downstream breaching inundation levels for both Keowee and Jocassee Dams, which are considered critical infrastructure, should be designated as CEII. Such information could be useful to a person planning an attack on the critical infrastructure, and thus the public release of such information could negatively affect national security, economic security, and public health and safety.

2.

The information should be designated as CEII for 5 years and is likely to need to be renewed beyond this date because the continued presence of both Keowee and Jocassee Dams for the foreseeable future.

3.

The portion or pages of the enclosed document for which FERCs CEII designation is being requested are clearly identified by being outlined in red using Adobes Redact bracketing tool.

The MOU provides that the CEII Coordinator will endeavor to provide the NRC with a determination within ten (10) business days. However, given that this arose in the context of an adjudicatory proceeding that is time sensitive, the NRC staff would greatly appreciate it if this review could be expedited.
