M240112 USNRC September 11, 2024 Page 2 of 2 NRC RAI DFP-3 To ensure that the trust agreement is effective and certifying the trustees signature and authority to enter into the agreement, the NRC request that the licensee submit a signed and dated notarized letter of acknowledgement in support of the standby trust agreement within 45 days of NRC approval of the DCE.

GNF-As 2022 submittal (Reference 2) of the DFP contained an uncompleted Form Letter of Acknowledgement (page 8.37 of GNF-A DFP Rev. 8). NRC has stated a notarized version is required. GNF-As original submittal of a DFP included with the request for NRC consent to transfer ownership (submitted on January 26, 2000 to Director, NMSS) includes the original, completed and notarized Form Letter of Acknowledgement from the Bank of New York. The original Standby Trust Agreement was accepted by NRC via letter from M. Lamastra (NRC) to C.M. Vaughan (GNF-A) on December 12, 2000.

While the DFP cost amounts are periodically adjusted as needed, the original Standby Trust Agreement acknowledgement is still in effect. The original signatures and notary are shown on the following page.

Future GNF-A DFP submittals will continue to address NRCs concern.
