Regarding the draft Environmental Assessment for ACOs February 13, 2023, application for the Phase 2+ amendment to increase the possession limits to support production of approximately 1,400 kg of high-assay low-enriched uranium (HALEU) UF6 for the duration of ACOs contract with DOE, NRC reiterated that it had not received any comments from the state agencies to date (NRC had requested comments by July 28, 2024). The NRC expects to complete the amendment by the requested date of September 30, 2024.

The NRC discussed the EA for the Phase 2+ amendment request, and in particular the issuance schedule pertaining to Section 107(g)(1)(B) of the National Environmental Policy Act of 1969, as Amended (NEPA). The NRC staff provided background information regarding the changes in NEPA that necessitated this discussion, described recent activities to complete the EA, and stated that the EA and FONSI should be published before the end of August 2024. The NRC staff noted that the schedule previously agreed upon by the NRC and ACO is to complete the licensing action by September 30, 2024. No objections were raised and there were no questions about this topic.

The above paragraph constitutes the NRC staffs documentation of consultation regarding the EA deadline that is required in Section 107(g)(2) of NEPA.
