Meeting Summary:
The U.S. Nuclear Regulatory Commission (NRC) staff conducted the meeting in accordance with NRC Management Directive 3.5, Attendance at NRC Staff-Sponsored Meetings (ML21180A271). The meetings objective was to discuss X-energys Quality Assurance Program Description (QAPD) topical report applicability to Title 10 of the Code of Federal Regulations (10 CFR) Part 71, Packaging and Transportation of Radioactive Material, activities. The main points of discussion during the meeting included:
The NRC staff requested clarification of X-energys desire to and basis for applying the QAPD topical report to 10 CFR Part 71 at this time. X-energy discussed that the statements in the topical report were not intended as a request to apply the topical report to 10 CFR Part 71 activities.
The NRC staff recommended that X-energy consider submitting a letter of notification to the NRC to document and clarify that it is not requesting applicability of the topical report to 10 CFR Part 71. The NRC staff also suggested that X-energy consider removing the associated statements in future revisions of the topical report. X-energy stated that it would discuss the options internally and update the NRC staff on its decision to provide a letter to the NRC and/or remove the statements from future revisions of the topical report.
