Good afternoon,
Your email message of June 28th to Federal Agencies on the CEQs Memorandum of Implementation regarding the updated NEPA-implementing regulations, requested information on how agencies should proceed with updating their NEPA procedures and directed agencies to notify CEQ by August 1, 2024, of their Senior Agency Official and Chief Public Engagement Officer designations. As a follow-up to my July 31 email, I am contacting you to provide the U.S. Nuclear Regulatory Commissions (NRCs) formal response.
The NRC is reaffirming the Executive Director of Operation (EDO) as the Senior Agency Official and designates Mirela Gavrilas, the NRC's EDO. With regard to the Chief Public Engagement Officer,the NRC is exploringthebest options for enhancing public engagement at the agency. We wish to complete these internal deliberations before designating a ChiefPublic Engagement Officer. In the interim, please contact the EDO (in the role of Senior Agency Official) for matters that would otherwise be addressed by a Chief Public Engagement Officer.
Additionally, while the NRC is in compliance with the FRA NEPA amendments, the NRC staff has proposed various options for Commission consideration to address, in part, the changes to NEPA per the FRA in SECY-24-0046, Implementation of the Fiscal Responsibility Act of 2023 National Environmental Policy Act Amendments. In this SECY paper, the NRC staff recommends evaluating CEQs final rule for potential revisions to 10 CFR Part 51 and NRC staff NEPA guidance in a rulemaking process.

Dear Federal NEPA Contacts,
The revisions to CEQs regulations implementing NEPA are effective July 1, 2024. Attached please find a memorandum from CEQ Chair Mallory on implementation of the updated regulations. This memo provides information on how agencies should proceed with updating their NEPA procedures and directs agencies to notify CEQ by August 1, 2024, of their senior agency official and Chief Public Engagement Officer designations.
CEQ will be hosting Federal NEPA contacts meetings and office hours to share information, provide assistance, and answer questions related to implementation of CEQs regulations. We are holding the next Federal NEPA contacts meeting on July 9 at 3:00 pm. We will be providing information on the office hours soon.
