Attached is the public withholding determination for Nuclear Energy Institute (NEI)
Technical Report NEI 20-07, Draft Revision E, Guidance for Addressing Common Cause Failure in High Safety-Significant Safety-Related Digital I&C Systems. By letter dated March 14, 2024 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML24074A460), the NEI submitted an affidavit dated March 14, 2024, requesting that the information contained in NEI 20-07, Draft Revision E be withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR). A nonproprietary copy of this document (ADAMS Accession No. ML24074A463) has been placed in the U.S. Nuclear Regulatory Commissions (NRCs) Public Document Room and added to the NRC Library in ADAMS. The NRC staff evaluated NEIs request to withhold information that it has identified as privileged or confidential commercial information from public release and determined that the information requested to be withheld is consistent with 10 CFR 2.390. Therefore, the submitted information marked as privileged or confidential commercial information will be withheld from public disclosure.
