Dear Ryan Joyce:
The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated June 25, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24177A217).
The proposed action would allow Southern Nuclear Operating Company to load MPC-68M-CBS in the HI-STORM 100 Cask System at the Hatch Nuclear Plant Units 1 and 2 ISFSI in the storage condition where the terms, conditions, and specifications in CoC No. 1014, Amendment No. 11 are not met, solely applies to the three currently loaded and five planned loadings of non-compliant CBS casks beginning in April 2025. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i);
72.212(b)(11) and 72.214.
