SUMMARY
OF THE CONTINUATION COMMENT-GATHERING MEETING RELATED TO THE AMERICAN SOCIETY OF MECHANICAL ENGINEERS CODE CASE N-883 On June 11, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held a continuation of the comment-gathering public meeting held on May 8, 2024, to discuss with external stakeholders several potential ideas being considered by the NRC staff for inclusion of Code Case N-883, Construction of Items Prior to the Establishment of a Section III, Division 1 Owner,Section III, Division 1, into Regulatory Guide (RG) 1.84, Design, Fabrication, and Materials Code Case Acceptability, ASME Section III. This meeting provided an opportunity for external stakeholders to share their views, particularly with respect to the nuclear industrys related needs for using Code Case N-883. The meeting notice can be found in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML24138A113. Ms. Kerri Kavanagh, Chief, Quality Assurance and Vendor Inspection Branch, Division of Reactor Oversight, Office of Nuclear Reactor Regulation (NRR), started the meeting by stating that the purpose was to provide an additional opportunity for external stakeholders to share their views on the nuclear industrys needs related to the use of Code Case N-883, and also to continue the discussion on the four potential ideas being considered by the NRC staff for inclusion of Code Case N-883 into RG 1.84.

Ms. Kavanagh stated that the slides had been prepared and are being released to support ongoing public discussions. The four potential ideas in the slides were not subject to NRC management and legal reviews and approvals. The slides are subject to change and should not be interpreted as final official agency positions and descriptions.
Ms. Kavanagh revisited the four potential ideas under consideration by the NRC staff and requested feedback from the stakeholders and encouraged engagement with the participants.
Several stakeholders provided questions and/or comments that were addressed by the NRC staff.
Common themes provided by the external stakeholders included questions on what third party oversight in replacement of an Owner would look like in the existing regulatory framework and why is it needed, and suggestions that the NRC staff could participate in surveys performed by the American Society of Mechanical Engineers (ASME) or train Authorized Nuclear Inspectors in areas related to Appendix B to 10 CFR Part 50.
Towards the end of the meeting, Mr. Michael King, Deputy Office Director for Reactor Programs, NRR, summarized the issues of concern identified by the participants and key takeaways from the meeting. For example, what entities could fill the role of third-party oversight, the need for rulemaking, the role played by the ASME Code categorization of components, and the applicability of the ASME Code in general.
At the conclusion of the meeting, Ms. Kavanagh provided closing remarks for the meeting and stated that if there is an opportunity or further discussion is needed, we could schedule a future public meeting.
