COOPER NUCLEAR STATION - FEDERAL EMERGENCY MANAGEMENT AGENCY LEVEL 1 FINDING FROM A MAY 9, 2024, MEDICAL SERVICES DRILL

Dear Matt Nee:

On May 21, 2024, the U.S. Nuclear Regulatory Commission (NRC) and Federal Emergency Management Agency (FEMA) completed an evaluation of a biennial emergency preparedness exercise at Cooper Nuclear Station. Additionally, in support of their evaluation of the exercise, FEMA evaluated an out-of-sequence Medical Services Drill on May 9, 2024, which included the participation of the Community Hospital-Fairfax, located in Fairfax, MO, and the Nodaway County Ambulance Service, located in Maryville, MO. During the May 9th Medical Services Drill, FEMA identified a Level 1 Finding related to the performance of activities performed by both offsite response organizations.

Enclosed is correspondence from FEMA Region 7 to the Missouri State Emergency Management Agency (SEMA), dated June 24, 2024, which provides detailed information about the issues involved in the Level 1 Finding (ADAMS Accession No. ML24197A068). However, as noted in the enclosed, SEMA promptly initiated corrective actions to address the observed performance issues, and on June 17, 2024, FEMA Region 7 staff determined that the issues were sufficiently corrected such that the Level 1 Finding could be closed. FEMA further noted that the closure of the Level 1 Finding would be documented in a forthcoming FEMA After Action Report for the 2024 Cooper Nuclear Station Biennial Exercise.

In transmitting this letter to Cooper Nuclear Station, the NRC is performing our responsibilities described in the Memorandum of Understanding (MOU) between FEMA and NRC (Appendix A to 44 CFR 353). This MOU is also available in ADAMS at Accession No. ML24184A043.

Specifically, this letter and its enclosure serve as formal notification of the Level 1 Finding and our responsibility to monitor Nebraska Public Power Districts efforts to work with State and local authorities to correct any identified inadequacies identified by FEMA. However, given that FEMA has determined that the corrective actions taken by the state were sufficient to correct the issues identified, the NRC has further determined that no additional review is warranted, that M. Nee 2 reasonable assurance remains, and the offsite organizations retain their ability to take appropriate protective measures to ensure the health and safety of the public.
