STATUS OF RECOMMENDATIONS: AUDIT OF THE NUCLEAR REGULATORY COMMISSIONS OVERSIGHT OF COUNTERFEIT, FRAUDULENT, AND SUSPECT ITEMS AT NUCLEAR POWER REACTORS (OIG-22-A-06)

REFERENCE:

DIRECTOR, OFFICE OF NUCLEAR REACTOR REGULATION, MEMORANDUM DATED MAY 24, 2024 Attached is the Office of the Inspector Generals (OIG) analysis and status of recommendations as discussed in the agencys response dated May 24, 2024. Based on this response, recommendations 4 and 6 are now closed. Recommendations 1, 2, 3, 5, 7, and 8 were previously closed. All recommendations related to this audit report are now closed.

Recommendation 4:

Clearly define counterfeit, fraudulent, and suspect items (CFSI).

Agency Response The NRC has included the definition of CFSI in its updated Dated May 24, 2024:

inspection procedures and guidance, as identified in this and previous responses to recommendation 6, which references the documents and inspection guidance that have been and will be updated.

OIG Analysis:

The OIG reviewed the agency actions listed above and determined the actions met the intent of the recommendation. This recommendation is closed.

Recommendation 6:

Develop inspection guidance with examples pertaining to identifying CFSI in inspection procedures.

Agency Response The NRC staff has updated the following regulatory guides Dated May 24, 2024:

(RGs):

RG 1.164, Revision 1, Dedication of Commercial-Grade Items for Use in Nuclear Power Plants, issued April 2024 (Agencywide Documents Access and Management System Accession No. ML24038A310)

RG 1.234, Revision 1, Evaluating Deviations and Reporting Defects and Noncompliance Under 10 CFR Part 21, issued March 2024 (ML24038A311)

The NRC anticipates completing, by May 2024, the administrative change to Regulatory Issue Summary 2015-08, Oversight of Counterfeit, Fraudulent, and Suspect Items in the Nuclear Industry, dated June 24, 2015 (ML15008A191), to reference the definition of CFSI included in the two RGs listed above. The NRC staff has updated RG 1.164 and RG 1.234. The update to RIS 2015-08 is considered administrative in nature and would just reference the latest revisions to these two RGs.

The OIG reviewed the agency actions listed above and determined the actions met the intent of the recommendation. This recommendation is closed.
