NOTIFICATION OF TRANSFER OF AUTHORITY TO THE NUCLEAR REGULATORY COMMISSION: SEALED SOURCE AND DEVICE REGISTRATION CERTIFICATES
Dear Mr. DuBose:
By letter dated September 29, 2023, the U.S. Nuclear Regulatory Commission (NRC) indicated that you hold two sealed source and device (SSD) registration certificates which were issued to you by the New York State Department of Health (NYSDOH). On May 9, 2023, Governor Kathy Hochul requested that the State of New York relinquish, to the U.S. Nuclear Regulatory Commission (NRC), its authority of issuing SSD registration certificates. A copy of the letter from Governor Hochul may be found in the NRCs Agencywide Documents Access and Management System using the Accession Number ML23131A254. The Commission has approved that request with an effective date of August 28, 2023.
Further to our September 29, 2023 letter, we reviewed the information received from transfer records, and found that Inficon, Inc. has three SSD registration certificates.
We are contacting you to inform you that the NRC will issue three, instead of two, new SSD registration certificates to replace the ones issued by NYSDOH. Until you receive the replacement certificates from us, the SSD sheets issued by NYSDOH will remain valid and you may use or reference it for your customers as you did prior to this transfer of authority. If you wish to make any changes to your registration certificates such as an amendment or inactivation before you receive the new ones, you should contact the NRC, not NYSDOH. This transfer of authority is limited to the SSD registration certificates only, and it does not affect your radioactive materials license or any other license which was issued by the NYSDOH. After the NRC issues the new registration certificate, you will be subject to the NRC registration fees in accordance with Title 10 of the Code of Federal Regulations Paragraph 171.16(d), Table Item 9.
Our records indicate that you have the following SSD registrations, issued by NYSDOH, which we will transfer to the NRC:

As indicated above, if you have other SSD registrations, that we may not be aware of, please let us know. We do not know the exact date on which you will receive the new SSD registration certificate. Our plan is to complete the transition within one year from the date of this letter.
